Fisheye Connect Attendee/Purchase Policy

Our goal at Fisheye Connect is to make your booking experience easy, efficient, and equitable, so we can get you on your way to workshop events as quickly as possible. The following Attendee policies are designed to ensure your satisfaction and understanding of the booking process on FisheyeConnect.com. If you have any questions about the information below, please contact us. This Attendee Policy is subject to, and incorporates by this reference, the Terms of Use and all other Policies of Fisheye Connect. Each workshop opening that you book is a license to attend a particular workshop, and is subject to the additional terms set forth in that posting or by that Instructor. This document, along with all other Fisheye Connect Policies (including Terms of Use), represents the entire agreement between individuals purchasing workshop openings (hereafter "Purchaser," "Student," or "Attendee") and Fisheye Connect, Inc. (hereafter "Fisheye Connect" or "FEC"). These Terms and Policies govern use of Fisheye Connect's website, located at http://FisheyeConnect.com/ (hereafter "FisheyeConnect.com" or "the Site"), and any other Fisheye Connect services. Terms Used Herein

"Instructor," "Provider," or "Promoter" refer to individuals posting or promoting workshop openings. "Attendee" refers to a customer who has reserved and paid for a spot in an Instructor's workshop. "Fisheye Connect" or "FEC" refer to Fisheye Connect, Inc. "FisheyeConnect.com" or "the Site" refer to Fisheye Connect's website, located at http://www.FisheyeConnect.com/. "Workshop" refers to the learning experience provided by Instructors to Attendees through Fisheye Connect. "Booking" refers to the act of reserving and paying for a workshop opening through Fisheye Connect. "Opening" (hereafter "seats," or "openings") means a position which can be bought by a person or for a person to participate in the workshop provided by the Instructor.

Account Information

When you start the process of creating an account on FEC, if you do not have an account that previously has been used to book openings on FEC then you will be asked for credit card information. Your email address will be your username, and you will also be given a chance to create a unique password at this time. If you already have a properly functioning account with such information, you will be able to log in, as well as view your past bookings. Note: FEC reserves the right to discontinue any Attendee account at any time at the sole discretion of Fisheye Connect.

Currency

All prices for workshops on Fisheye Connect, regardless of location, are stated in U.S. Dollars. ATTENTION INTERNATIONAL ATTENDEES: Some credit card companies and financial institutions may add a surcharge for currency conversion. Please speak with your Credit Card Company or financial institution for details on their policies. FEC cannot be held responsible for any charges stemming from international currency conversion. Workshop Openings are subject to all local, state/providence, and national taxes. You hereby agree to be held responsible to pay all applicable taxes, including those stemming from your location, the workshop location, and FEC's location.

Who You Are Buying From

Fisheye Connect is an arm of Fisheye Connect, Inc., and acts as the agent to those who are promoting or otherwise providing the workshops for which you book openings or seats, such as photographers, schools, corporations, seminars, and photography clubs ("Instructor"). When you book an opening for a workshop, then Fisheye Connect will be handling the transaction and collecting payment for the Instructor. FEC does not own, operate, plan, coordinate, schedule, or in any other way dictate when, where, or how a workshop is conducted. The descriptions of workshops posted on FisheyeConnect.com are the work of the individual Instructors, and you agree not to hold FEC responsible for any deficiency in accuracy or completeness of those descriptions, or the actual activities taking place during the workshop.

Pricing and Availability

FEC books workshop openings on behalf of photographers, schools, corporations, seminars, and photography clubs, which means FEC does not set the workshop prices or determine workshop locations. Workshops are booked through FisheyeConnect.com. Be aware, openings for popular workshops may sell out quickly. Occasionally, additional openings may be available prior to the workshop. However, FEC does not control these circumstances or there frequency. Once in the booking process, be aware there is a time limit to complete your booking, which is 15 minutes before you seat will go back into the openings. When booking workshops on FisheyeConnect.com, you will be limited to one (1) opening for each FEC account used to order. When booking workshop openings online with FEC, please ensure you are looking for workshops and booking an opening using only one browser window. Looking up workshops using multiple browser windows could result in losing your seat.

Order Confirmation & Billing Verification

If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with FEC Customer Service whether or not your order has been placed. Only you may be aware of any problems that may occur during the booking process. Orders are processed only after a billing address, and other billing information, has been verified.

Reviews

After attending a workshop booked through FEC, you will receive an email at the email address list in your account containing the opportunity to review the workshop you attended. This survey is optional and anonymous, and contains a one-to-five-star rating system, in ascending order of satisfaction. Any comment you make will remain anonymous, and only the comments made will be visible to FEC and your Instructor.

Cancelled and Postponed Events

In the event a workshop you have previously booked and paid for is cancelled, the Instructor will generally reschedule the workshop. If the Instructor does not reschedule the workshop, or if you will be unable to attend the make-up workshop, please refer to our Refund Policy set forth below. Note that by booking a workshop through FisheyeConnect.com, you agree that FEC cannot be held liable for any ancillary or incidental expenses you may incur in the event of a rescheduling or cancellation. These expenses may include, but are not limited to, travel expenses, accommodations, and vacation days from employers used to attend the scheduled workshop.

Refunds and Exchanges

Before booking workshops, carefully review your workshop information, including location, date, time, and cost. Refunds will not be granted through FEC. Please contact your instructor for refunds or problems. You agree that any attempt made to exchange to another workshop date will be arranged between you and the Instructor. Without limiting the generality of the foregoing, you will not contact FEC to seek a refund or exchange from FEC when there has been no cancellation or rescheduling of the workshop, and you will not dispute or otherwise seek a "chargeback" from the company whose credit card you used to book openings from the Site.

Pricing and Other Errors

If the amount you pay for an opening is incorrect regardless of whether because of an error in a price posted on this website or otherwise communicated to you, or you are able to book an opening before its scheduled on-sale or presale date or you are able to book an opening that was not supposed to have been released for sale, then: FEC will have the right to cancel that seat (or the order for that seat) and refund to you the amount that you paid, minus a processing fee depending on the problem with the end user. If done by instructor error, the instructor will be responsible for any changes or cancellation refunds.

Limitation of Liability

Some workshops may include activities, which may be strenuous, dangerous, or otherwise carry the risk of injury, death, or property damage. While Workshop descriptions are deemed reliable, they are not guaranteed accurate or complete by FEC. You agree that FEC is not responsible for any inaccurate, incomplete, or misleading information in postings available on FisheyeConnect.com. You assume all risks incidental to the workshop for which an opening is booked, whether before, during or after the workshop. Further, you hereby waive any claims for personal injury, death, or property damage against FEC on behalf of yourself and any accompanying minor.

Recording, Transmission and Exhibition

You agree not to record or transmit, or aid in recording or transmitting, any description, account, picture, or reproduction of the workshop without express written permission by the Instructor. You grant permission to FEC and the Instructor to utilize your name, image, likeness, acts, poses, photographs taken, appearance, movements, and statements in any live or recorded audio, video, or photography display or other transmission, exhibition, publication or reproduction made of, or at, the workshop for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.

Unlawful Re-Sale of Openings; Commercial Purposes

Unlawful resale of openings (or attempted resale) is grounds for seizure and cancellation without compensation. An opening shall not be used for advertising, promotions, contests or sweepstakes, unless formal written authorization is given by the Instructor, provided that even if such consent is obtained, any use of FEC's trademarks and other intellectual property is subject to FEC's consent. By booking an opening through FEC, you will disclose the name of each Attendee included in the order. Once the individual Attendees have been so identified, you are prohibited from selling, giving, negotiating, or otherwise transferring you booking to other individuals without the prior consent of the Instructor.

This page, along with all other Terms and Policies on this site, are the exclusive intellectual property of Fisheye Connect, Inc., and may not be reproduced without the consent of Fisheye Connect, Inc.

On Demand

Through holding an account with FEC, you hereby agree that you are authorized to visit, view and to retain a copy of pages or videos of this Site for solely your own personal use, and for no other purpose. You shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review photography instructor information, workshop information and promotional information for your personal use only, to publish information related to workshop listings, or to purchase available workshop tickets unless otherwise specifically authorized by FEC to do so. In the event that you have duplicated, downloaded, published, modified, distributed material on this Site for any purpose other than to personally review photography, workshop or promotional information, or in any other manner unlawfully used any content on the Site, your account will be immediately terminated with FEC. You will be legally responsible for any damages incurred by FEC or any Instructor as a result of your unlawful use of the content found therein.
