Fisheye Connect Instructor Policy
Terms Used Herein
"Instructor," "Provider," or "Promoter" refer to individuals posting or promoting workshop openings. "Attendee" (hereafter "Purchaser," "Student," or "Attendee") refers to a customer who has reserved and paid for a spot in an Instructor's workshop. "Fisheye Connect" or "FEC" refer to Fisheye Connect, Inc. "FisheyeConnect.com" or "the Site" refer to Fisheye Connect's website, located at http://www.FisheyeConnect.com/. "Workshop" refers to the learning experience provided by Instructors to Attendees through Fisheye Connect. "Booking" refers to the act of reserving and paying for a workshop opening through Fisheye Connect. "Opening" (hereafter "seats" or "openings") means a position which can be bought by a person or for a person to participate in the workshop provided by the Instructor.
When you start the process of creating a posting on FEC, if you do not have an account that previously has been used to post openings on Fisheye Connect then you will be asked for credit card information to be used solely for your application fee. Your email address will be your username, and you will also be given a chance to create a unique password at this time. If you already have a properly functioning account with such information, you will be able to log in. As you post workshop seats for sale, you will be required, or presented with the opportunity to provide, certain additional information. You agree by signing up for a FEC account, that you will not use your FEC account, or any other service rendered by FEC, to solicit or engage in any illegal, obscene, or otherwise objectionable activities, nor solicit or disseminate any such materials. Failure to comply with this or any other FEC policy may result in account termination, with no refund for profile setup fee.. Attendees will be asked to participate in an optional anonymous survey after attending your workshop. This survey will carry a rating system from one to five stars, in ascending order of satisfaction. FEC will use that information to uphold quality instructors on the site, and in order to provide instructors with feedback. FEC also reserves the right to discontinue any Instructor account at any time at the sole discretion of FEC.
By posting workshops on FEC, you agree to guarantee that the information in your posting is accurate and complete, and that you will indemnify and hold harmless FEC for any misinformation an Attendee may take away from your posting. It will be incumbent upon you to clarify or answer any questions an Attendee may have about your workshop information. Such information includes, but is not limited to Price, Location, Dates and Times, Workshop goals, Instructor names and experience, and whether the workshop will be live or broadcast by some method. Postings, and the workshops to which they refer, must meet with FEC's standards. Further, you must disclose any activities that may be dangerous or rigorous. FEC cannot be held liable for any injury or property damage, and you hereby indemnify and hold harmless FEC against any injury or property damage, whether accidental or intentional, caused by or caused to any Attendee, Instructor, or Third Party that occurs before, during, or after your workshop. Further, you hereby indemnify and hold harmless FEC for any claims for personal injury, death, or property damage stemming from your workshop, whether sought by you, and Attendee, or a third party. Note: Fisheye Connect reserves the right to remove any workshop posting at any time at the sole discretion of Fisheye Connect.
Number of Seats in an Event & Pricing
You will be asked how many openings/seats are available through FEC for a particular event. . You must further guarantee that all workshop seats posted on FisheyeConnect.com will be available for booking. If you are planning to book your workshop by additional means other than FisheyeConnect.com, preference must be given to bookings made available through FisheyeConnect.com in the event of an overbooking. You will also be asked to set your workshop seat Price. The attendee would pay to Fisheye Connect an amount that equals the Posting Price. Your Price must include all applicable taxes. Please consult your local jurisdiction regarding taxation and other requirements.
When an Event Becomes Irrevocable
You will be able to delete a workshop posting by logging on to FisheyeConnect.com and entering your user name, password and additional information associated with such posting, until such time as any openings in a posting are booked by an attendee. If you change your mind, and decide to postpone or cancel your workshop, simply delete the workshop event before any seats are booked. However, once an attendee books any seats in an event, you will not be able to modify or cancel the posting, or to stop the bookings from being relied upon.
How to Receive Your Proceeds; Form of Payment
If any openings you have posted are booked, FEC will collect the total fee, and hold all proceeds. The money paid for bookings will be reconciled biweekly and will be disbursed directly to you the instructor. At this time, disbursement shall be made through check(or direct deposit) by that amount, minus FEC's applicable booking fees. Direct deposit can be selected as form as payout but a minimum of 100 per payout is required.
Neither we nor anyone else makes any guarantee that any workshops posted by you will be booked through FEC. IN NO EVENT SHALL OUR (OR OUR AFFILIATES, EMPLOYEES, AGENTS, LICENSEES OR OTHER RELATED PARTIES') AGGREGATE LIABILITY TO YOU RELATED TO YOUR USE OF FEC EXCEED AMOUNT (IF ANY) OF YOUR PROCEEDS DUE FROM ANY BOOKINGS THAT OCCUR (WHERE SUCH USE IS THAT OF POSTING, OR TRYING TO POST AN AVAILABLE OPENING FOR A WORKSHOP YOU UNDERSTAND AND AGREE THAT FEC WILL NOT OWE YOU ANY MONEYS FOR WORKSHOP OPENINGS YOU HAVE POSTED OR TRIED TO POST ON WWW.FISHEYECONNECT.COM THAT HAVE NOT BEEN BOOKED BY AN ATTENDEE.
By using FEC services and agreeing to these terms, you represent and warrant that you are the actual Instructor of each workshop that you post on Fisheye Connect, and that your representation of your workshop on FEC is accurate and complete. You further represent and warrant that if you are an employee, representative or agent of a workshop Instructor associated with a workshop which you are posting on FEC, you have express consent of the workshop provider to post the workshop for booking on FEC. You agree not to use FEC for any illegal, lewd, or fraudulent purpose, or to post any openings that you do not have and not to impersonate any person or entity, including without limitation, a workshop instructor.
If a workshop for which you have posted an opening becomes cancelled, postponed or rescheduled before it is booked through FEC, you will be allowed to remove your posting. Once a posted opening is booked, you must give adequate notice to cancel or reschedule the workshop. It is incumbent upon you the Instructor to reschedule within a reasonable period of time from the original date of the workshop. If any attendees have incurred costs, including but not limited to travel expenses, FEC cannot be held responsible to reimburse those costs. By removing a post from FEC after booking, you agree to reimburse the cost of any such Attendee expenses.
You agree to accurately report and pay all income, sales and other taxes (if any) that are owed in connection with any booking of any of your openings or any remission of funds by us to you. FEC will not be responsible for paying any taxes in connection with your workshop.
By you, the Instructor, or any agent, affiliate, employee or representative of the Instructor, submitting any text, image, graphic, copy, video contact information or any other content to Fisheye Connect, Inc., you, your agent, affiliate, employee or representative are confirming and swearing that you own all legal rights in and to said content submitted. Further, in submitting said content, you hereby giving Fisheye Connect, Inc. all rights to produce, resell, modify, alter, encode, edit, broadcast and distribute said content. In the event that you do not own full legal rights to said content and FEC is held legally accountable to any third party damaged by the posting and of this content, you will indemnify FEC hold FEC harmless from any type suit.
In submitting any text, image, graphic, copy, video contact information or any other content, you, the Instructor, or any agent, affiliate, employee or representative of you, are granting unto FEC the ability to fully license said content, and consent to and authorize FEC to produce, resell, modify, alter, encode, edit, broadcast and distribute the content as FEC's material. By submitted said content, you warrant and affirm that any prior copyright releases, consents and/or permissions (if required) have been obtained and that you, the Instructor, or any agent, affiliate, employee or representative of you, have obtained the legal right to use any material, design, graphic, image, person or property that appears in said content. You, your agent, affiliate, employee or representative, are solely responsible for any accuracy of the content submitted. You will not upload, use or solicit any unauthorized products, materials or services to any FEC users. Any content obtained by you from FEC shall be used solely for teaching purposes.
